Mediation is an out-of-court legal process by which the parties to a claim come before a neutral mediator to discuss resolution of the issues in dispute. The mediator’s role at mediation is to facilitate the discussion between the parties. Every mediation is a little different and will be catered to your specific case. Generally, all the important people will be there like you, your Grillo Law representative, and the insurance company.
Mediation is unique opportunity to exclusively discuss the issues in a claim freely and openly. Many, many cases settle at mediation, however it isn’t necessary or mandatory in all cases.
Claims commenced in Toronto, Windsor, and Ottawa are subject to mandatory mediation before a trial can be scheduled. In other jurisdictions, the parties have to agree to mediation and are not required to participate in one before setting the matter down for a trial.
